Lasting Power Of Attorney

At David Clark Laws and Probate we have vast experience of drafting and obtaining Lasting Power of Attorney.  A Lasting Power of Attorney is a Legal Document which allows others to make important decisions for you during your lifetime.

A Lasting Power of Attorney (LPA) provides Legal Authority to the Attorney (the personal appointed to make your decisions within the Legal Document) to deal with your affairs whether these relate to your finances and property or your health and care requirements.

It is important to understand the effects of the LPA prior to signing the same and we will ensure that this is explained fully, in plain English, both face to face and in writing at all times.  We can only prepare a Legal Power of Attorney if we are confident that you are in a sound state of mind and that there is no undue pressure being placed upon you to do so.

Our Fees for drafting Legal Powers of Attorney are always fixed and you will be told our fee prior to the same being drafted.  Our fees start from:

  • Single Lasting Power of Attorney  from £235.00 Plus VAT
  • Mirror Power Of Attorneys from £395.00 Plus VAT

What Lasting Powers of Attorneys can be prepared?

There are two types of LPA’s one which deals with financial affairs and the other medical and welfare matters.  They are called:

  • Property & Financial Affairs Lasting Power of Attorney
  • Health & Welfare Lasting Power of Attorney

It is your choice as to whether one or both of the above are put in place on your behalf and we will help you make this decision at the time of your initial consultation with us.

The first of the two LPAs listed above allows another person or people (the appointed Attorney/s) to make decisions on your behalf about treatments, healthcare requirements and living arrangements if you at some point during your lifetime become unable to make those decisions on your own due to either illness or infirmity of mind.   This document is only used by your appointed Attorney if you lack the mental capacity to make the appropriate decisions yourself.

It is therefore very important that you understand the purpose and effect of the Health & Welfare Lasting Power of Attorney before executing the same as in the event of you becoming ill it maybe that, if you are unable to express your own wishes, verbally or in writing and with sound mind, another person can make decisions on your behalf which at the time you may not agree with or wish for.  It would therefore be important for you to ensure that your wishes are recorded accurately.

The Latter LPA relates to financial affairs and appoints an Attorney to deal with all of your wishes relating to your property and finances within England and Wales.  This type of document can start immediately it is executed, passing immediate control to your Attorney, or only when it is determined by a medical professional that you are no longer sound of mind and no longer have Legal Capacity to make important decisions regarding your finances and property.

Why would I need a Lasting Power of Attorney?

There are many reasons our clients approach us to draft a Lasting Power of Attorney.  Some of the most common reasons are:

  • Age Related Concerns regarding managing finances
  • The Diagnosis of a degenerate or critical medical condition
  • Commercial reasons for Business Owners or Directors/Shareholders

It is often a misconceived idea that people believe that their husband, wife, son or daughter (their next of kin) have a right to step in and make decisions for them if something were to happen to mean they could not manage their own affairs.   Unfortunately this is not the case and it can be that those decisions become very slow and complicated due to legal reasons as to why certain decisions can or can not be made.

It is therefore very important, especially in a fast paced environment such as London, that every care is taken to ensure that every eventuality is considered and dealt with.  A couple can for example have a mirrored Lasting Power of Attorney for making health decisions or financial decisions should one or the other become unable to make those important decisions in life.
