At David Clark Laws and Probate we handle all kinds of complex estates and often are able to work on a fixed fee basis.  Where there are foreseen complexities these will be highlighted and an additional fee can be charged to handle those as they arise.  However in the straightforward administration of the Deceased estate to the Grant of Probate or Letters of Administration over £1.25 million.

Where the estate consists of no more than 3 properties in England and Wales and there are no more than 5 Bank Accounts and 7 Beneficiaries we will seek to work on the following fixed fee basis.

Where there is a will:

• 3% plus VAT of the total value of Probate.
• £6,500.00 plus VAT fixed (plus disbursements) for the first claim against the estate (where received)
• £250.00 plus VAT per hour (plus Disbursements) for any additional claims against the estate (where received)
• Example: The deceased’s estate entails 3 properties worth £2.5 million, there are £500,000.00 worth of gifts within the estate.  There are 7 beneficiaries within the will and one claim is made against the estate by a Dependent.  Our fees will be £115,800.00 including VAT (plus disbursements).

Where the deceased died intestate (without a will)

• 4% plus VAT of the total value of Probate
• £7500.00 Plus VAT fixed (plus disbursements) for each claim against the estate (where received)
• £250.00 plus VAT per hour (plus Disbursements) for any additional claims against the estate (where received)
• Example: The deceased’s estate entails 3 properties worth £2.5 million, there are £500,000.00 worth of gifts within the estate.  There are 7 beneficiaries within the will and one claim is made against the estate by a Dependent.  Our fees will be £153,000.00 including VAT (plus disbursements).

What is included within the Probate Premium Plus Package?

The Probate Premium Plus package includes the following work to be undertaken on behalf of the Executors or Administrators.

We take absolute responsibility for obtaining Probate or Letters of Administration on behalf of the estate including dealing with the Legal, property and estate administration, tax and any claims against the estate.  This includes:

• An initial consultation with an experienced Probate Specialist either at our offices, over the phone or by Skype / FaceTime.
• Undertaking all Legal Formalities to obtain the Grant of Probate or Letter of Administration.
• Defending or negotiating any claim against the estate from Dependants and providing full advice to Executors or Administrators of their obligations and personal Liabilities in dealing with distribution of the estate.  (Subject to an additional fee per claim as set out above.)

We will handle all affairs with HM Revenue and Customs on behalf of the Estate.

Free Wills for each Executor or Administrator including storage. (an additional charge of £95.00 plus VAT for mirrored wills)
